Kimmel v. Schultz et al.
Schultz recovered a judgment in Pennsylvania against Kimmel, Pius, and Kurtz, but the judgment was never satisfied. Schultz sued Kimmel in Jackson County Circuit Court to recover the same debt, and the court ruled for Schultz. Kimmel appealed the case to the Illinois Supreme Court. The Court reversed the judgment because the circuit court judgment was against only Kimmel, when it should have been against Kimmel, Pius, and Kurtz. When a suit is brought against several joint debtors, a recovery must be had against all or none.
